What is child pornography?

Under the Criminal Code, child pornography includes any photographic, filmed, video, video, written, or audio material that depicts a person under the age of 18 engaging in sexual activity.
Visual representations (photos, videos, images)
Visual content can be created by mechanical or electronic means (such as a camera, cell phone, or computer).
  • Show a person under the age of 18 (or represented as under 18) engaging in sexual activity; or
  • Are created for sexual purposes where the dominant characteristic is the sexual organs or anal region of a person under the age of 18.
Written documents and audio recordings
Written or audio recordings are considered child pornography if they:
  • Encourage or advise sexual activity with a person under the age of 18;
  • Describe, present, or simulate primarily sexual activity involving a person under the age of 18.

Offences and potential sanctions

Production of child pornography

This includes creating, printing, or publishing child pornography. This also applies to the possession of such materials with the intention of publishing them.

  • Maximum sentence: 14 years
  • Minimum sentence: 1 year

Possible defense:

If the accused believed that the person represented was at least 18 years of age, he must prove that he took all reasonable steps to confirm her age and to ensure that she was not represented as being under 18 years of age.

Dissemination of child pornography

Distribution includes the transmission, sale, import, export, or provision of child pornography. It also includes advertising or possession of it for these purposes.

  • Maximum sentence: 14 years
  • Minimum sentence: 1 year

Possession of child pornography

Possession may be pursued either by dismissal or by summary proceedings.

Offence punishable by criminal act

  • Maximum sentence: 10 years
  • Minimum sentence: 1 year

  • Minimum sentence: 6 months

Accessing Child Pornography

A person can be sued if they voluntarily view child pornography or if they act in such a way that it is sent to them.

  • Minimum sentence: 6 months

Possible defences

If the offense was committed for profit, the court must consider this to be an aggravating circumstance, which often results in a harsher sentence.

Legitimate purpose

A person is not guilty if the material was created or manipulated for legitimate purposes, such as:

  • Administration of justice
  • Scientific, medical or educational work
  • Artistic goals

No excessive risk for minors

Even if there is a legitimate reason, the accused must demonstrate that his actions did not present an undue risk to persons under 18. The courts assess this issue based on the facts specific to each case.
