Stages of a criminal case in Quebec
A criminal case does not always move in a straight line. Some stages are optional, several hearings may occur, and the case can end in different ways. This general map helps you prepare better questions.
Police investigation and file assessment
The police investigate and may send a file to the prosecution. A prosecutor then assesses whether proceedings should be initiated. Depending on the case, there may be an arrest, release, detention or a document requiring attendance in court.
Charges and first appearance
The appearance is an initial court step after charges are laid. If the accused is detained and release is opposed, a bail hearing may be required. The first appearance is generally not the trial.
Disclosure and case-management hearings
Pro forma hearings may allow the defence to review the file, the prosecution to disclose evidence and the parties to continue discussions. The number of hearings depends in part on the complexity and state of the evidence.
Plea, trial or another outcome
A not-guilty plea may lead toward trial preparation. A guilty plea leads to sentencing submissions. Other outcomes may be possible depending on the file, including a withdrawal, acquittal or measures authorized by law. No general diagram predicts the outcome of a specific case.
Sentence and possible appeal
After a finding of guilt, the court hears sentencing submissions. Appeal rights may exist, subject to criteria and time limits that depend on the decision and procedure. Seek advice immediately if you are considering an appeal.

Is the first appearance the trial?
Generally not. It is an early court step. Disclosure, case-management hearings and other decisions may be required before any trial.
Why are there several court dates?
Some hearings are used to receive or review disclosure, discuss next steps, manage the case or schedule another stage. The purpose of each date should be confirmed in your file.
Does every case have a preliminary inquiry?
No. The DPCP diagram identifies it as an optional step when applicable. Availability depends in part on the charge and current procedural rules.
